The Office of the Insurance Commissioner’s (OIC) is seeking candidates to fill an exempt Deputy Insurance Commissioner position for our Legal Affairs Division located in Tumwater, WA.  
 
This position is appointed by the Insurance Commissioner and serves as a member of the executive management team.  As the Deputy for the Legal Affairs division, this position is responsible for overseeing the legal services provided by the Insurance Enforcement Specialists (staff attorneys) to the other divisions within the agency.   The Deputy is also responsible for the deployment of investigative resources to enforce compliance with the Insurance Code, including matters related to insures, insurance producers and other licensees, and unauthorized insurance transactions within Washington State.
 
The Legal Affairs Division provides OIC with the necessary legal tools to achieve fair and efficient regulation of the insurance industry to protect consumers, the public interest, and our state’s economy.

This is a civil service exempt position.  Salary depends on qualifications, with an annual salary maximum up to $134,496.

Duties

The Deputy Insurance Commissioner for the Legal Affairs Division reports to the Chief Deputy and has delegated appointing authority approval.  Overseeing a division of 22 FTEs including three direct reports, the division provides the agency with the necessary legal tools to achieve fair and efficient regulation of the insurance industry.  The Deputy works closely with the agency’s assigned Assistant Attorney Generals and is responsible for the agency enforcement program and chairs the Compliance Committee that determines penalties for violations.  
 
Duties include, but are not limited to:

  • Implement, manage, and maintain the goals and objectives of the Commissioner as defined in the strategic plan.
  • Provide legal guidance to the Commissioner, Chief Deputy and other division deputies.
  • Ensure prompt delivery of legal services to OIC staff; consistent with the requirements of OIC executive management.
  • Ensure that all legal services and products meet appropriate standards and applicable ethical requirements.
  • Develop strategic direction for the division.
  • Create and implement new processes to improve the effectiveness and efficiency of the division.
  • Plan, lead, organize, and control the work performed by the division.   Delegate appropriately to ensure the division achieves planned results in support of the OIC’s strategic plan.
  • Act as the Chief Enforcement Officer for the state relating to insurance laws the OIC is charged to enforce.
  • Provide a safe and fair work environment for division employees.
  • Represent the OIC with external stakeholders/licensees and the executive and legislative branch. Coordinate activities of the division with other state and national entities, the National Association of Insurance Commissioners (NAIC), the public and the Office of the Attorney General. 
  • Maintain the highest standards of personal/professional ethical conduct.

Qualifications

The OIC is looking for innovative candidates with demonstrated leadership competencies that include but not limited to the following areas:

  • Successful experience modeling leadership and performance characteristics that promote professionalism, integrity, accountability, and public service, and a cooperative, positive work environment.
  • Experience with managing political situations and understanding political climates or issues that require proactive and appropriate consultation to an organization or agency’s top-level executive (i.e. agency directors, commissioners, chief deputy commission, etc.).
  • A successful track record of developing and implementing long-term strategic direction for an organization.
  • Experience applying critical thinking and collaboration to solve complex programs.  This includes the ability to think ahead to identify changing “landscapes” and proactively make decisions.
  • Demonstrate high levels of initiative, tenacity, perseverance, and deliver results.

Required Qualifications:
  • A juris doctorate from an accredited law school as recognized by the American Bar Association.
  • A Washington Bar Association member or licensed to practice law in other states or territories for the United States or the District of Columbia.
  • A minimum of five years of management experience.
  • A minimum of five years of progressively responsible interpretation and implementation of complex regulatory statues and regulations.
  • Experience in comprehending, interpreting, and applying federal, state, and local laws, codes and regulations, and policy and procedures.
  • Proficient in effective budget management. 
 
Preferred Qualifications:
  • Five (5) years demonstrated leadership experience in a management position that includes the supervision of other managers or attorneys, or both. 
  • Minimum of three (3) years demonstrated leadership experience overseeing government regulatory or criminal investigations and a thorough understanding of the methods, principals, standards, and laws governing such investigations.
  • Minimum of five (5) years of experience in insurance law including insurance litigation, insurance regulation, administrative law, and health law.
  • Minimum of five (5) years’ experience in strategic planning principles.
  • Minimum of three (3) years of experience managing attorneys and investigators in a state department of insurance.
  • Familiarity with all lines of insurance, insurance company operations, insurance sales practices, insurance producer practices, insurance law and the regulatory responsibilities of the OIC.
  • Experience in alternative dispute resolution including mediation.
