POSITION DESCRIPTION: The City of Tacoma is recruiting for a Hearing Examiner for conducting adjudicative proceedings pertaining to a wide variety of City functions. 

This is a full-time administrative and professional position of a quasi-judicial nature. The position is responsible for conducting quasi-judicial adjudicative proceedings concerning a number of City functions including, but not limited to, land use environmental permits; local business and occupational taxes and business licensing; local improvement district formations and assessment rolls; discriminatory practices under the City's Human Rights Code; forfeitures under the Uniform Controlled Substances Act; utility billing disputes; civil infractions imposed for various permit violations; Ethics Code violations; Minimum Building and Structures Code violations; and Nuisance Code violations. In most instances, the decision of the Hearing Examiner constitutes the final decision by the City. The work of the Hearing Examiner is exercised independently of other City departments, commissions, boards, and agencies. Supervision is exercised over a small staff. 

The successful candidate must have expertise in quasi-judicial processes and procedures, e.g., conducting pre-hearing conferences; conducting of informal hearings and formal adjudicative proceedings and post-hearing procedures; a working knowledge of the rules of evidence in the administration adjudicative context; possess knowledge in municipal law including: land use/environmental law; regulatory licensing law; local B & O tax law, and employment law; be knowledgeable concerning statutory and case law relating to conflicts of interest, appearance of fairness, and limitations on ex parte contacts; have the ability to prepare well-reasoned and legally sound findings of fact, conclusions of law and decisions or recommendations, and complete accurate records and reports; and have the ability to establish effective working relationships with departmental officials, other employees, regulatory agencies and the public. 

This position requires the ability to conduct proceedings in a fair and impartial manner which projects actual and the appearance of fairness and to perform the duties of the Hearing Examiner in accordance with high ethical standards. The successful candidate must possess good interpersonal skills, be able to independently perform their job responsibilities, and effectively manage a small office. In addition, this position is a contributing member of Tacoma's Senior Management Team.

QUALIFICATIONS: An attorney licensed to practice law in Washington or is a member of the Washington State Bar Association who has been granted judicial status. A minimum of 5 years of Washington municipal, county or state law practice or private practice experience in areas of the law that are within the jurisdiction of the Hearing Examiner. Substantial experience serving as a local Hearing Examiner or appearing in a representative capacity in local or state quasi-judicial proceedings is desired.
